I'm paraphrasing the likely rule, but you get the idea. All programs have that one or something like it in their rulebook. It's usually used when a student-athlete breaks a law or commits a crime and the team will be leaving all actions up to the judicial process.

It's open-ended enough that it can encompass anything, but it's ambiguous enough that it keeps the details out of the media until something happens with the charges - whether they're filed, dropped, whatever.

It's called the judicial process. It takes time, and it's not complete. They've only gotten to the point where they have arraigned him.

Same process happens with every other person in the United States. Commit crime, victim brings charges, investigation takes place, charges dropped or arraignment occurs.

While NYPIrate is a fucking assclown, and shouldn't have ever used the phrases "asking for it" or "deserved it," but he does have kind of a point.

Much like not hanging out in East Liberty if you're white, girls should never invite guys back to their rooms at 2 am after 1. a night of drinking and 2. meeting said guy in the bar. Said conduct can reasonably be interpreted as "i want to be more than just friends with you herrm" (though I doubt those words have ever been spoken).

Now, I'm not one to ever force myself on a girl, but I've definitely gone home with girls post-bar and there was only one thing on both of our minds. At the very least, there was at least some making out, but usually a lot more. Now, this is not untypical. Girls aren't stupid. They know what they're implying when they ask you to come home with them. If they didn't want at least *something* to happen, they shouldn't ask, or they are potentially putting theirselves in a compromising position.

That being said, no one knows the details. Maybe she came home with him and only wanted to hook up with no sex, and when he got on top of her, he wouldn't stop when she said that things had gone as far as she wanted, and he did rape her. Maybe she passed out and he had sex with her (which is totally uncalled for, and also, is rape).

Then again, maybe she brought him home, had sex with him, and then got pissed at herself for doing it, and figured that because she was drunk, she would be absolved of it and possibly make some money by suing the school and the football program for not providing a safe on campus environment or for endangering her safety by letting someone into the school that would do stuff like that.

As I said, I'm really interested in the details here. Until I find out that he did something egregious, i'm going to err on Scott's side because that situation usually indicates she wanted physical intimacy to occur, whether Herrm and his Monopoly-playing-and-knitting-mittens-at-2-am female friends want to admit so or not.

I completely agree. I said as much in my first post. If she had passed out, or he kept going after she said no, lock the fucker up.

I just said I'm holding judgment until the facts come out, but based on the situation, I'd say its more likely that she wanted it to happen, based on the facts that are out now. If he had broke into her dorm and did this, it'd be different. It sounds like he was invited back after the bar, so that changes the situation.

And your sample size of one woman and then assuming that she is representative of most women is an example of logical thinking? If I worked by that logic, I would have conclude that 80% of all Americans are in the military.

Sometimes you make me want to give my license back to the Texas bar. How can you have excelled at something that you havent done yet. You just passed the bar a week ago. Have you already won three cases in front of the Supreme Court? The logic of your post leaves out a lot of logic.

Most women will admit they are irrational thinkers and speak in generalities? You are out of your fucking mind.

First of all, women are more apt to make logical decisions that are tempered with compassion. That does not mean it is an emotional decision. Many women are extremely pragmatic in their professional lives and personal lives.

Saying women are irrational thinkers shows how absolutely small minded you are. You brag and brag about being brilliant because you are a lawyer and therefore possess some magic logic that no one of the female persuasion could possibly have.

I have news for you, because you are so narrow minded, I guarantee there are going to be dozens and dozens of women lawyers who are going to chew you up and spit you out in the courtroom.

I can never determine if you are just young and inexperienced in life that you are so blistering blinded in your chauvenistic attitude, or whether you really are just stupid. It's probably a combination.

Like I said before, if there are women telling you they are irrational thinkers and speak in generalities by the droves as you say....then you need to stop befriending battered women in shelters and mental institutions.
